A Day to Remember from Florida formed in 2003 and are being described as a metalcore/pop-punk/rock band. The bands current line-up include Jeremy McKinnon, Neil Westfall, Josh Woodard, Alex Shelnutt and Kevin Skaff. The band is set to release their new album "Common Courtesy" October the 8th.

An album which have seen a lot of delays. Common Courtesy was announced by the band with a countdown included. Once the countdown hit zero, first single "Violence (Enough Is Enough)" was released. This was back in December and since there's been a lot of speculation when the album actually will be released. On March 18th, Jeremy McKinnon, announced on Twitter that "Common Courtesy is officially tracked! Now, onward to mixing.". Still no official track list.

The band announced Friday night at a show in Michigan that the judge ruled that they could release their album October 8, without Victory. Here is the live video of that announcement.

    One week… that’s it! Getting no track list or fully mastered songs has made the wait for Common Courtesy insane. Can’t wait to finally listen to this record after waiting what seemed like forever!

    I doubt this will leak anytime before it’s official release due to tightness associated with it, the only people who have probably heard it are the band themselves, and Victory. I haven’t heard of press copies being distributed either, which narrows down a possibility of a leak before the release.

      If ADTR wins on Wednesday, I’d expect press copies to be distributed the next day to publications, with reviews to be ready for Monday. And if Victory Records actually had a copy of the album, they’d leak the shit out of it if ADTR beat them.

      Panics album was streaming on YouTube via their label unless it leaked before that but panic has a very good label backing them whereas Victory sucks and ADTR isn’t allowed to release anything until the lawsuit is finalized tomorrow. If the album were to get leaked before then ADTR would be in big trouble most likely

    I have been checking this page constantly since its creation, and I gotta say: even though the lack information is frustrating, it has made for one of the most hyped albums of the year. Seriously, thinking back to when I first heard FTWHH, I never would have thought this band would be generating this much buzz over an album. I’ve also been blown away by ADTR’s dedication to this album, and its integrity. Think about, it, these guys delayed an album MAJORLY, knowing it would upset fans, cost them money, and potentially cost them their career all for the sake of Common Courtesy’s integrity. I’ve never witnessed a band so level-headed as ADTR. No matter how this controversy with Victory affects them, I will be with them every step of the way because this is a band that deserves success. #ADTRNeverDies

    A Day To Remember are alleging:
    A)
    that they have fulfilled their 5-album deal with Victory records (the
    band actually lists eight albums which they assert count toward
    fulfilling this obligation: What Separates Me From You, three editions
    of Homesick, two editions of For Those Who Have Heart, Old Record, and
    the Attack Of The Killer B-Sides EP).
    B) that Victory filed copyright
    applications for the sound recordings of A Day To Remember’s albums
    that A Day To Remember do not believe were assigned to Victory.
    C) that Victory are inappropriately withholding money owed to A Day To Remember from merch sales.
    D)
    that Victory are additionally wrongly withholding >$100,000 from A
    Day To Remember as a “penalty” as part of a dispute over merch sales
    rights.

    A Day To Remember are requesting from the Court:
    A)
    a declaration that A Day To Remember have fulfilled their contract, and
    that A Day To Remember are now free to sign with other labels.
    B) a declaration that A Day To Remember own all of their sound recording copyrights.
    C) an accounting from Victory of any money which might be due to the band.
    D) a reward of damages and attorneys fees from Victory.

    Victory’s Response To A Day To Remember:
    A) denies all of A Day To Remember’s allegations,
    B) raises a number of technical defenses, and
    C) asserts their own claim against A Day To Remember.

    This claim that Victory is asserting against A Day To Remember alleges:
    A) that A Day To Remember manufactured and sold their own merch via the internet in violation of their contract with Victory.
    B) that A Day To Remember interfered with Victory’s ability to manufacture merch by refusing to approve new designs.

    Victory are requesting from the Court:
    A) dismissal of A Day To Remember’s complaint.
    B) a reward of damages from A Day To Remember.

      I’ve been saying this for fucking ages, ADTR have given Victory plenty of albums. Victory demand re-releases, EP’s and all that shit because they think it doesn’t count as an album. In fact, Victory wanted an album back in ’08 but the band weren’t ready yet, so they demanded they make Old Record, and at the time the band thought that was fair enough. In retrospect, if the label don’t consider it a real, contractual album then how the fuck can they be allowed to make those demands?
