A Day to Remember from Florida formed in 2003 and are being described as a metalcore/pop-punk/rock band. The bands current line-up include Jeremy McKinnon, Neil Westfall, Josh Woodard, Alex Shelnutt and Kevin Skaff. The band is set to release their new album "Common Courtesy" October the 8th.

An album which have seen a lot of delays. Common Courtesy was announced by the band with a countdown included. Once the countdown hit zero, first single "Violence (Enough Is Enough)" was released. This was back in December and since there's been a lot of speculation when the album actually will be released. On March 18th, Jeremy McKinnon, announced on Twitter that "Common Courtesy is officially tracked! Now, onward to mixing.". Still no official track list.

The band announced Friday night at a show in Michigan that the judge ruled that they could release their album October 8, without Victory. Here is the live video of that announcement.

    I have to admit, I’m kind of glad ADTR hasn’t released any mastered singles yet. Although I’ve heard three songs off CC, they’ve all been like an appetizer to what’s about to come. So pumped!

    Hey, I have heard that ADTR has a day off from their tour on the 7October2013 for the court case that has consistently delayed this album. Additionally if the judge can’t reach a decision on ADTR/Victory Records there’s a very strong possibility of another delay on the release date. Victory Records is saying ADTR hasn’t met the contract which they have, and ADTR says otherwise. Furthermore, all memorabilia from Hot Topics and other stores has been pulled by request of band cause they have not been receiving money for such products. Victory is also claiming ADTR didn’t live up to their contract by saying they have not put out 5 studio albums under their label and have put stuff out and sold their products using their own money. That is all I have heard about the band and Victory Records. Any more information I hear I will keep you all informed.

    Jeremy just answered this on tumblr. Hope this puts some people’s minds a little more at rest!

    Fans are waiting in anticipation to hear about the lawsuit. Did you go to court or not? You guys have been silent for hours. What’s happening?

    The judge decided a day or so before the 2nd that we didn’t need a hearing for him to decide the case…we still haven’t heard from him. We hit him up today and reminded him if we haven’t heard back by Monday the record will be put out as planned.

      i don’t think this is a good thing to say to a judge which is deciding if your next album can be released or not. looks like they’re keeping him “under pressure”. If i were them, i wouldn’t say a word and release the album like planned haha

      I think it’s smart that they’re making sure to get an answer by then, though. They’re sort of warning that “hey, if you don’t get the verdict to us dude then we’re releasing this for the fans okay? Just so you know.”

    Potentially bad news.
    AP says ADTR still have to produce 2 more records for Victory. I don’t know how the band feels about this, but I know that they want us to have the CD. I think that, if it’s true, they’ll just release it on victory to make us happy.

      “Also, the sole basis for the court’s denial of the injunction was that Victory would not suffer “irreparable harm” that could not be compensated by money damages if the album were to be self released, in that it has ample evidence to prove its damages against the band (in the form of lost profits if ADTR does proceed to self release Common Courtesy)” They won’t release it on victory. the motion was denied

      To clarify: Based off of Victory’s lawyer’s statement, A Day To Remember are allowed to self-release Common Courtesy, but Victory may end up receiving the profits from the album if the court further decides that the band owes the label two albums. I think it’s very clear to us right now

        Okay I see. Should have read it a few times. They’re allowed to self release it, but Victory may receive profits. Makes sense I guess. But the main thing to take away is CC is almost definitely coming out on the 8th now. Fantastic news!!

      I hope that’s true. But at the same time, wouldn’t be be amazing if it didn’t leak and everyone got to hear the album all at the same time? CC is one of the most hyped albums I’ve ever heard of, and I think it would be cool for everyone to hear it at the same time.
      But still, and leak wouldn’t exactly be terrible!

      long story short, ADTR won (but not really). they can release CC independently, but Victory may get the profits later on. and ADTR will STILL owe them 2 albums. so its a good thing for the fans, but shitty for the band
