A Day to Remember from Florida formed in 2003 and are being described as a metalcore/pop-punk/rock band. The bands current line-up include Jeremy McKinnon, Neil Westfall, Josh Woodard, Alex Shelnutt and Kevin Skaff. The band is set to release their new album "Common Courtesy" October the 8th.

An album which have seen a lot of delays. Common Courtesy was announced by the band with a countdown included. Once the countdown hit zero, first single "Violence (Enough Is Enough)" was released. This was back in December and since there's been a lot of speculation when the album actually will be released. On March 18th, Jeremy McKinnon, announced on Twitter that "Common Courtesy is officially tracked! Now, onward to mixing.". Still no official track list.

The band announced Friday night at a show in Michigan that the judge ruled that they could release their album October 8, without Victory. Here is the live video of that announcement.

    There will be a physical copy of the album too, it’s just coming out a bit later than the 8th. Anyone who preorders the digital copy will get a good percentage off the physical copy as well :)

    Have you seen the video uploaded by Victory saying that “The End will begin at October 8th” ? The backing track of the video seems to be Jeremy’s scream a lot! What do you think about that guys?

      Yeah. Theres been a mix of rumors between it being about ADTR and about Emmure. I am hoping it has to do with Emmure.

      I don’t think it’s Jeremy. However, I do feel like this could be closely related to ADTR. The video kind of creeps me out. Record labels are always supposed to be professional – and it seems like Victory is almost threatening ADTR. I get this feeling that they are saying that ADTR won’t be able to go on without them. Then again, I could be wrong, and I hope I am. This whole video could be the complete opposite of what most of us are thinking.. but the thing is, it’s just such a dark and mysterious setting. This video could possibly mean that Victory’s lawsuit with ADTR is over (probably not). But, I think this could also be about a totally different band. I actually just listened to it again… and I realized that it does sound a bit like Jeremy, not exactly similar, but there’s a resemblance. I hope this has nothing to do with ADTR unless it’s about the lawsuit being over.

      Not sure if this means anything, but I think he screams “we are the lost and the damned” at the near end of the video. That’s what I heard at least.

        It just seems like a marketing ploy for something totally unrelated to ADTR but they are using this attention to advertise something else and let’s be honest It is kinda clever because it has got all of us talking and wondering but I agree with you that it seems really unprofessional if it was some sort of anti ADTR video what kind of established company would drop to that level? That’s why I think it might not be about ADTR they would only be hurting there own company by stooping to such a low all because they are feeling bitter, I have heard that pre orders have been going really well for ADTR so perhaps Victory is feeling the pinch now and need a way to keep themselves relevant by possibly using this “The End” video to promote another band, possibly emmure or something new or maybe they see this as a end of an era type thing and a new start to what they have planned in the future, They obviously knew this video would make everyone start talking lawsuit so they aren’t stupid but it’s interesting to see were they take this and what it really is.

        That was a lot of words haha I apologize but the whole thing is interesting and I’m a bit of a nerd when it comes to business practices and marketing so I think a lot into it.

        I think if Victory were smart they will congratulate ADTR on the new album to try sustain a friendly business appearance (if they even have any) and stop they silly childish stuff they have going on now.

    reading through, i dont think many people are understanding, this album is being paid out of pocket… the reason they had the australian tour was to fund finishing the album, its an indie release. Victory wanted the album a certain way and they said “fuck the man” and made CC :P

      It wasn’t that Victory wanted it a certain way, it was that Victory wanted them to start making the album when the lawsuit about the royalties from WSMFY ended. And they weren’t prepared to let them ‘sit on their careers and ruin the album’ so they made the album themselves.

    So the “The End” video that Victory posted today now has an annotation that says “free music” and when you click it, it takes you to another victory records video for their 2013 Free Rock Sampler. And it doesn’t start the video at 00:00. Whenever you click the annotation, it starts the video at 20:11. And at that time it is the very end of ADTR’s “This Is The House That Doubt Built”. But the next song is an Emmure song. This still doesn’t clear up who the “The End” video is about. But it definitely makes me curious about it.

    That ‘The End Begins’ shit that Victory posted must be related to ADTR because a few hours later, they put a facebook status up thanking fans for their online support during this mess and Jeremy posted those lyrics that are obviously a dig at Victory.

    We should get #FuckVictoryRecords trending on twitter. I think this would be the way forward.

    Alright guys. So I just got my new Alternative Press magazine in the mail today through my subscription with Brendon Urie on the cover but that’s irrelevant. Anyways the first thing i noticed was there was a new ADTR interview with Jeremy in the magazine that I’d like to share some of the things that stick out from it with you guys.

    This interview is not the same as the one posted on AP’s website by the way.
    This is gonna be a long post so be prepared.

    THINGS TAKEN AWAY FROM WHAT I’M ABOUT TO GO OVER: (Basically shortned version)
    ADTR aren’t sellouts
    Song title

    Jeremy goes over again about how much he cares about his fans

    Insight into both ADTR’s and Victory’s thoughts on the lawsuit

    So one thing I want to point out is once again an interview with Jeremy screams everything but sell-out. Jeremy says things like “I don’t care about fame, money or any of this bulls***” Just countless things throughout the interview point to this.

    Also Jeremy points out that they don’t care whatsoever about first-week sales but instead total sales. This just shows that they are okay with releasing the album as soon as they possibly can for us even if it means a hit on charting high.

    An awesome quote “Nobody cares about something as much as I care about music and doesn’t do something special with their life. When you see us on this next tour, it’s going to be pretty obvious we believe in our future. Otherwise, it’s a sh*t-ton of money for nothing.”

    When asked about topics Jeremy digs into lyrically on Common Courtesy Jeremy talks about how he was talking to the guys from TDWP called “Life Lessons Learned The Hard Way” that is a very heavy song and told the guys about the song line-by-line which they responded “what the f*ck man?”. Jeremy also says he told them about how “Tom Denney, Andrew Wade and I wrote the biggest songs on the alum n five days. The story surrounding this album, the lawsuit, is the craziest things that’s ever happened in my life. There was so much sh*t we were going through, and I think I did a very good job of putting into words.”

    Jeremy also says The Ghost Inside were some of the first people to hear the entire album and were surprised by how heavy it was.

    He points out that they wrote an acoustic song while touring with BMTH

    GUYS THERE IS SO MUCH MORE I HOPE YOU READ ALL OF THIS.

    When asked how will the record come out Jeremy responded “It’s up in the air. As of right now, Victory is not putting this album out. We are going to put it out ourselves. People think the album has been done forever and the legal stuff is holding it up. That’s not true. If you want to keep it real, the album isn’t done right now [Laughs] I don’t have the final copy. It’s our perspective that we’re done with our Victory Records contract” From me: We now know that the album though from the online Interview if you guys remember so this must’ve been a bit before

    I absolutely love this: “They just want our album. [Brummel is] dragging it out because he thinks we’ll run out of money or that enough time will pass that our fans will stop caring about us. He thinks we’ll be forced to go back to Victory. But guess what? This band isn’t dong it for the money. I have no problem putting this album out in whatever shape or form gets it to our fans. All that matters is that my fans get to hear this album. That’s it”

    Jeremy does go on to say he is thankful for Tony Brummel giving them the opportunity to be where they are now and that they appreciate and will never forget the initial investment they made but “if this guy had just done right by us and let us have a say in our career without making us feel like a-holes we would have stayed on Victory forever. It’s all going to come out eventually.”

    Something funny Jeremy says he loves listening to ADTR and when people say they don’t listen to their own band he’s like “Then you don’t love what you do” He says he loves his music and that he is basically putting his life on a soundtrack.

    VICTORY’S RESPONSE

    “AP contacted Victory Records founder Tony Brummel to get his side of the story. He declined comment but directed us to his attorney, Robert S. Meloni of Meloni and McCaffrey, who spoke on behalf of the label.”

    “The issue in the lawsuit filed by the band is whether they satisfied their recording commitment. They band say they have; Victory has argued they have not. Every record label is entitled to rely on contracts signed with its artists. The issue is not Victory is the bad guy. It is not. This is a band who want to try to get out of a contract they signed. Victory is maintaining it is owed two more albums, and we are confident that the court and a jury will agree with us on that one when the day comes for the jury trial.”

    Victory is also claiming ADTR broke contract with merchandising rights as the band contacted Hot Topic to stop selling ADTR merch (which Jeremy discussing earlier in which he basically said they didn’t want Victory getting money so they asked them to stop selling the shirts.) which created a legal issue. He wants it to come out on Victory The band is saying it’s coming out Oct. 8; we say it’s not coming out on Oct 8, at least [not] self-released by the band. It’s got to come out on victory, and Victory will put its full force behind it like [Brummel] does with every artist.”

    Then AP adds “Just as this issue was going to press, AP has learned that according to a court ruling sent over by Victory’s attorneys Common Courtesy can’t come out anywhere until the court hears and rules on Victory’s motion for preliminary injunction on October 2nd.”

    That took a while to type. I missed a lot of stuff but that’s the main things. I definitely suggest going and picking up this issue or borrowing it from someone for this interview. Hopefully i didn’t make a big error in typing this like leaving out sentences because my computer was acting up but I don’t think I did.

    Let me know your thoughts on some of that stuff.

They should have just released the album on that date and only if the person buy it. No pre orders. I bet everything that this motion by Victory have happened only because they’ve said the release date, and this will be analysed by the court on Oct 2ns

        Tony Brummel more than likely has himself set up with a really good lawyer so there is a huge chance it wont come out by then and if they leak it that could also cause even more issues.. funny as songs on this talk about the Victory records lawsuit yet they still wanna have the album put out on there label haha

    In the midst of all the speculation of the release date, I feel confident that it will be out October 8th. I really honestly believe that, but won’t be surprised if it’s pushed back. But the band seems so confident and set firm on the 8th, so maybe we’ll see some sort of leak… who knows.

    I found this video of their Live acoustic show in Vegas.
    and they let fans ask them questions.
