A Day to Remember from Florida formed in 2003 and are being described as a metalcore/pop-punk/rock band. The bands current line-up include Jeremy McKinnon, Neil Westfall, Josh Woodard, Alex Shelnutt and Kevin Skaff. The band is set to release their new album "Common Courtesy" October the 8th.
An album which have seen a lot of delays. Common Courtesy was announced by the band with a countdown included. Once the countdown hit zero, first single "Violence (Enough Is Enough)" was released. This was back in December and since there's been a lot of speculation when the album actually will be released. On March 18th, Jeremy McKinnon, announced on Twitter that "Common Courtesy is officially tracked! Now, onward to mixing.". Still no official track list.
The band announced Friday night at a show in Michigan that the judge ruled that they could release their album October 8, without Victory. Here is the live video of that announcement.
Once this leaks, I don’t know if i’ll be able to stop jizzing enough to actually listen to it.
That’s a bit crass…. But it will certainly be a memorable day. But until it leaks, Mayday Parade’s new CD will be playing for me.

I’m extremely happy that it’s finally coming out. I’m sort of going to miss coming to this page everyday to see what’s up. I’ve been checking this site everyday for the past year and a half for information on this album. The amount of hype that’s built up is impossible to explain for me.
Until it leaks go listen to/check out ADTR’s first ep Halos for Angels,Dirt for the Dead. Crazy to see how far they have come!

I saw Tom before he had face tats i can barely remember him without them though. Alex was probably like what 15-17 at the time of this pic. It’s strange to think i was 14 when i saw them for the first time in 2007 with less then a hundred people. Its awesome to see how big that they’ve gotten throughout the years even though there show at the roxy in la with less then 500 people was my favorite out of the 4 shows i saw them at this year. CAN NOT WAIT FOR THIS ALBUM!!!!!!

If the judge ruled ADTR can release the album, how come they have to wait to see if they owe Victory two more albums?
Because ADTR won the money that Victory stole on Merch.

While Victory is disappointed with the ruling, and disagrees with the court’s conclusions, it comes as no surprise. Courts rarely grant negative injunctions of this nature, but the circumstances of this case presented a unique opportunity for such a ruling. Having said that, in denying Victory’s motion, the court’s reasoning actually contained silver linings that significantly favored Victory. First, the court held that it supports Victory’s argument about the construction of the recording contract – that ADTR is still obligated to deliver two more albums to Victory — “at last equally, if not more so, than that offered by ADTR.” That is the core issue in this case and the only one that really matters in the end, so Victory is heartened that the court agreed with Victory’s position on that core issue. Also, the sole basis for the court’s denial of the injunction was that Victory would not suffer “irreparable harm” that could not be compensated by money damages if the album were to be self released, in that it has ample evidence to prove its damages against the band (in the form of lost profits if ADTR does proceed to self release Common Courtesy). That is, even if the band self releases it, Victory is likely to be awarded any profits the band makes on that album, plus additional lost profits suffered by Victory based on the fact that Victory would undeniably do a far better job at marketing the album had Victory released it, which is what Victory is known for and is the reason why ADTR signed with Victory in the first place. In sum, it is a “successful” defeat in a way, and one which Victory welcomed because of the manner in which the Court rendered its opinion.
This case will proceed to trial, and Victory is looking forward to the opportunity to vindicate the baseless claims filed by ADTR.

So what respect have they actually won in? He says that if they self release CC, they’ll have to pay Victory damages, and they will still owe them 2 albums.
In which case, they have to release it on Victory. Nothing else makes sense.

It’s going to sell big just purely because it’s an ADTR album and the anticipation surrounding it. However, it’s not going to sell as much as it would through Victory, because they have the money for Advertisment that ADTR probably don’t.

According to AltPress the band and management release this statement (I can’t find it on their Facebook or anything of the sort but I figured id post here):
A federal judge today ruled that A Day To Remember are free to release their new album Common Courtesy without Victory Records. In an Order issued earlier today, U.S District Court Judge John Z. Lee denied Victory Records’ Motion for a Preliminary Injunction in which Victory had sought to block the band from releasing this new album without Victory’s involvement.
In a statement this evening the band offered: “In May of 2011 we joined the long list of bands that have filed suit against Victory Records. Although our case is still ongoing, we are very pleased with the judge’s decision to allow us to release our next record. The only thing that has mattered to us while dealing with this lawsuit was getting new music to our fans. We are finally going to do that on October 8th and we couldn’t be more excited!”

I meant a personal leak. Why would one of the band members leak it if they are free to release it Tuesday? Would only hurt their sales.

Since this is a self release, the chance of a leak has been small this whole time. Leaks usually result from labels handing out press releases to generate hype, then those get leaked. I’m sure the mastered copy of CC is with someone they trust, and is not affiliated with Victory, example: Andrew Wade, Drew Russ etc

Here is how I am going to listen to this album for the first time: I will be turning my phone off, turning all the lights off in my house, and cracking it up FULL blast on my computer……paradise.
